BJ Doyle

BJ was called to the bar in 2025, after admission as a solicitor in 2020. BJ has a broad commercial practice, with particular focus on building and construction. He regularly appears unled in the Supreme, District and Magistrates Courts of Queensland, as well as the Federal Court and QCAT.

In particular, BJ’s experience includes things like:

  • defending an application for judgment due to failure to provide a payment schedule in response to a payment claim under the Building Industry Fairness (Security of Payment) Act 2017 (Qld);

  • appearing in contested interlocutory applications such as an application for leave to file a third party notice late in the proceeding;

  • applying to set aside statutory demands due to offsetting claims arising out of a construction contract;

  • applying for declarations voiding adjudicator’s decisions under the Building Industry Fairness (Security of Payment) Act 2017 (Qld);

  • obtaining judgment as a result of default on a deed of settlement;

  • defending an application by a neighbour for various injunctions relating to the construction of a new build home;

  • seeking orders for substitute service or informal service;

  • acting for the recipient of a detailed subpoena in limiting the scope of the subpoena and recovering the costs of complying with it, the value of which was contested;

  • obtaining leave for a bankrupt former-director to continue to manage his and his wife’s SMSF;

  • appearing for two defendants seeking costs orders against a plaintiff who settled the entirety of an ongoing proceeding against a separate defendant;

  • appearing for a builder at sentence for an offence under the Queensland Building and Construction Commission Act 1991 (Qld);

  • acting for a homeowner in relation to the interpretation of an access clause of a home building contract, and in the subsequent costs argument;

  • acting for a homeowner in a renewal application to correct previous orders so they could be properly enforced; and

  • appearing for the Office of the Director of Public Prosecutions in criminal sentencing matters.

BJ also regularly drafts and settles pleadings and other court documents, acts for clients at mediations, provides both formal advices and ad-hoc advice on strategic and legal matters throughout the course of proceedings in which he is engaged, and frequently assists with drafting and settling payment claims, payment schedules, adjudication applications and adjudication responses under the Building Industry Fairness (Security of Payment) Act 2017 (Qld).

BJ was previously the vice-president of the Gold Coast Junior Chamber of Commerce, and is now part of the Building Industry Practitioners’ Society Qld News Subcommittee, which involves liaising with authors of articles and case notes, editing those contributions before their national publication, and frequently contributing himself.
